TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of
Tally ("the App"), a home inventory application operated by Kiki
Collective LLC ("we," "us," or "our"). By downloading, installing, or
using Tally, you agree to be bound by these Terms. If you do not
agree, do not use the App.
1. ELIGIBILITY
You must be at least 13 years old to use Tally. If you are under 18,
you represent that a parent or legal guardian has reviewed and agreed
to these Terms on your behalf. By using the App, you represent that
you meet these requirements.
2. ACCOUNT REGISTRATION
Tally requires you to sign in using a third-party authentication
provider (currently Google and Apple). You are responsible for all
activity that occurs under your account. You agree to provide accurate
information during sign-in, keep your credentials secure and not share
access to your account, and notify us promptly if you suspect
unauthorized access. We are not responsible for any loss resulting
from unauthorized use of your account.
3. DESCRIPTION OF SERVICE
Tally is a personal home inventory application that uses artificial
intelligence to help you identify, catalog, and value household items
for insurance documentation and personal recordkeeping. Features
include AI-powered item scanning using your device camera, cloud
backup and sync of your inventory data, photo storage for items,
receipts, warranties, and appraisals, and insurance-ready reports
(Tally Pro).
Tally is a personal productivity tool. It is not a licensed insurance
provider, appraiser, or financial advisor. Value estimates provided by
the App are approximate and for personal reference only. They do not
constitute a professional appraisal and should not be relied upon for
insurance claims, legal proceedings, or financial decisions.
4. SUBSCRIPTIONS AND PAYMENT
Free Plan. The free tier of Tally includes limited access to AI
scanning and inventory rooms as described in the App. Free tier limits
may change with notice.
Tally Pro. Tally Pro is a paid subscription that unlocks unlimited
rooms, unlimited AI scans, cloud backup and sync, and insurance-ready
reports. Tally Pro is offered on a monthly or annual basis.
Billing. All purchases are processed through the Apple App Store or
Google Play Store. Payment is charged to your App Store or Play Store
account at confirmation of purchase. Your subscription automatically
renews unless cancelled at least 24 hours before the end of the
current billing period. You can manage or cancel your subscription in
your device's App Store or Play Store account settings.
Refunds. All refund requests are handled by Apple or Google in
accordance with their respective refund policies. Kiki Collective LLC
does not issue refunds directly.
Price Changes. We may change subscription prices with reasonable
advance notice. Continued use of Tally Pro after a price change
constitutes acceptance of the new pricing.
5. YOUR CONTENT
Ownership. You retain full ownership of all photos, item descriptions,
inventory data, and other content you create or upload through Tally
("Your Content").
License to Us. By uploading Your Content to Tally, you grant Kiki
Collective LLC a limited, non-exclusive, royalty-free license to
store, process, and display Your Content solely for the purpose of
operating the App and providing services to you. We do not sell,
share, or use Your Content to train AI models.
Your Responsibility. You are solely responsible for Your Content. You
agree not to upload content that is illegal, infringes on third-party
rights, or violates these Terms.
Deletion. You may delete your inventory data and account at any time
from within the App. Upon account deletion, Your Content will be
removed from our systems within 30 days, except where retention is
required by law.
6. AI-GENERATED ESTIMATES
Tally uses third-party AI services to identify items and estimate
replacement values. These estimates are generated automatically and
may be inaccurate, are not professional appraisals, are not guarantees
of insurance coverage or claim approval, and may not reflect current
market conditions. Always consult a licensed appraiser or your
insurance provider for official valuations.
7. PROHIBITED USES
You agree not to use Tally to violate any applicable law or
regulation, infringe upon the intellectual property rights of others,
submit false or fraudulent inventory data for insurance fraud
purposes, attempt to reverse-engineer or extract source code from the
App, access or tamper with the App's backend infrastructure, or use
the App in any way that could damage, disable, or impair our systems.
8. INTELLECTUAL PROPERTY
All elements of Tally — including the name, logo, design, code, AI
prompts, and report formats — are the intellectual property of Kiki
Collective LLC and are protected by applicable copyright, trademark,
and other intellectual property laws. Nothing in these Terms transfers
any intellectual property rights to you.
9. THIRD-PARTY SERVICES
Tally integrates with third-party services including Supabase (data
storage), OpenAI (AI processing), Apple (authentication and payments),
and Google (authentication). Your use of these services is subject to
their respective terms and privacy policies. We are not responsible
for the practices or content of third-party services.
10. PRIVACY
Your use of Tally is also governed by our Privacy Policy at
tallyitnow.com/privacy, which is incorporated into these Terms by
reference.
11. DISCLAIMERS
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF
ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES
OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND
NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE
UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL
COMPONENTS. WE ARE NOT RESPONSIBLE FOR ANY LOSS OF DATA. YOU ARE
RESPONSIBLE FOR MAINTAINING BACKUPS OF INFORMATION IMPORTANT TO YOU,
EVEN IF CLOUD SYNC IS ENABLED.
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KIKI COLLECTIVE LLC
AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE
FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE
DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF
OR IN CONNECTION WITH YOUR USE OF TALLY, EVEN IF WE HAVE BEEN ADVISED
OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY
CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED
THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR
$50, WHICHEVER IS GREATER.
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Kiki Collective LLC
and its officers, directors, employees, and agents from any claims,
damages, losses, liabilities, and expenses (including reasonable legal
fees) arising from: (a) your use of the App; (b) your violation of
these Terms; or (c) your violation of any third-party rights.
14. TERMINATION
We may suspend or terminate your access to Tally at any time, with or
without notice, if we believe you have violated these Terms or for any
other reason at our discretion. You may stop using the App and delete
your account at any time. Upon termination, your right to use the App
ceases immediately. Sections 5, 8, 11, 12, 13, and 16 survive
termination.
15. CHANGES TO THESE TERMS
We may update these Terms from time to time. We will notify you of
material changes by updating the "Last Updated" date at the top of
this page and, where appropriate, through an in-app notice. Your
continued use of Tally after changes take effect constitutes
acceptance of the revised Terms.
16. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of Colorado, without
regard to its conflict of law principles. Any dispute arising from
these Terms or your use of Tally shall be resolved exclusively in the
state or federal courts located in Colorado, and you consent to
personal jurisdiction in those courts.
17. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, constitute the entire
agreement between you and Kiki Collective LLC regarding your use of
Tally and supersede any prior agreements.
